LeadsUp LLC FZ ("Company", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application InkSight (the "App").

By using the App, you agree to the collection and use of information in accordance with this policy.

No face recognition and no biometrics. The App does not perform face detection, face recognition, facial analysis, or any other form of biometric identification. The App does not collect, generate, store, or transmit face data, faceprints, face templates, face geometry, fingerprints, or any other biometric identifier, and it does not use ARKit, the TrueDepth camera, or any depth-sensing hardware.

1. Information We Collect

We collect information to provide our services and improve user experience.

1.1. Data You Provide to Us

• Text Prompts and Style Selections: The text description you type and the tattoo style you select when generating a design.
• Reference Images: Images you select from your device to be used as a visual reference for generating a tattoo design.
• Try-On Photos: Photos you select from your device (or capture with the camera) showing the body area on which you want to preview a tattoo design.
• Customer Support Data: If you contact us via email, we collect your email address and the content of your message.

We do not ask for and do not require your name, phone number, postal address, date of birth, or any account registration in order to use the App.

1.2. Data Collected Automatically

• Device Information: Device model, operating system version, non-personal app-generated identifiers (e.g., an anonymous app-instance identifier used by our analytics provider), and mobile network information.
• Usage Data: Details of your use of the App, such as features used, styles selected, frequency of use, and crash logs.
• Subscription Data: We receive transaction receipts from Apple (App Store) to validate your subscription status. We do not collect or store your credit card information.

2. How We Use Your Information

We use the collected data for the following purposes:

• To Provide the Service: Processing your prompts, reference images, and try-on photos using AI technologies to deliver the requested tattoo design or preview.
• Safety and Content Moderation: Automatically screening prompts and images for content prohibited by our Terms of Service (for example, sexual content involving minors, or non-consensual intimate imagery).
• To Improve the App: Analyzing usage trends to fix bugs and optimize performance.
• To Manage Subscriptions: Verifying your purchase status (Free vs. Premium).
• Legal Compliance: Enforcing our Terms of Service and complying with applicable laws.

3. Processing of Prompts and Images

All three generation features of the App require cloud AI processing. Nothing is generated locally on your device.

3.1. Tattoo generation from a text prompt

The text prompt you write and the style you select are transmitted over an encrypted connection (HTTPS/TLS) to our AI processing provider kie.ai solely to generate the requested design. No image of you is involved in this feature.

3.2. Tattoo generation from an image

The reference image you select is transmitted over an encrypted connection (HTTPS/TLS) to our AI processing provider kie.ai solely to generate a tattoo design based on that reference. The image is used only as a visual input for generation. It is not analyzed to identify, recognize, or authenticate any person, and no biometric identifier is created from it.

3.3. Tattoo try-on

The photo you select and the tattoo design you chose are transmitted over an encrypted connection (HTTPS/TLS) to our AI processing provider kie.ai solely to render a preview of that design on the body area shown in the photo.

To place the design correctly, the AI model determines the outline, curvature, and lighting of the visible skin area in the photo. This is image-composition information used for a single rendering operation only. It is not used to identify, recognize, verify, or authenticate any person, is not converted into a biometric template, and is not stored or associated with you.

3.4. What we never do with your prompts or images

We do not use your prompts, reference images, or try-on photos:

• to identify, recognize, verify, or authenticate any person;
• to create a faceprint, body print, or any other biometric identifier;
• to infer age, gender, ethnicity, emotion, health, or any other characteristic;
• for advertising, marketing, profiling, or any form of behavioral targeting;
• to train, improve, or fine-tune AI or machine-learning models, whether ours or a third party's. We also contractually require our processing provider not to use your content to train their models.

3.5. Retention and results

Images and prompts transmitted for processing are automatically deleted from the provider's servers after processing and are retained only for the short period necessary to generate and deliver your result (see Section 5).

The final generated design or try-on preview is returned to you and is stored only on your device, in your device's photo library or in the App. We do not keep a copy.

To the extent any third party receives images or prompts from the App, we contractually require that third party to provide the same or equal protection for such data as is stated in this Privacy Policy, including the prohibitions on retention beyond processing, on model training, and on any use other than delivering the requested result to you.

4. Third-Party Service Providers

We share data with third parties only in the limited cases below.

A. AI Image Generation and Try-On

• Provider: kie.ia.
• What is shared: your text prompt and style selection; the reference image you selected; the try-on photo you selected.
• Purpose: generating the requested tattoo design or try-on preview.
• Retention: content is deleted automatically from the provider's servers after processing.
• Restrictions: the provider is contractually required to provide the same or equal protection for this data as described in this Privacy Policy, is not permitted to use your content for model training, and is not permitted to use the data for any purpose other than delivering your result.
• No biometric processing: the provider does not perform face detection, face recognition, or biometric identification on behalf of the App.

B. Analytics

• Providers may include: Google Analytics for Firebase or similar.
• What is shared: anonymous app-instance identifiers, device model, OS version, feature usage events, and crash logs.
• Not shared: your photos, reference images, or generated designs.

C. Subscriptions

• Provider: Apple (App Store).
• Purpose: processing and validating your subscription. We do not receive or store your payment card details.

We do not share your photos or generated designs with any advertising network, data broker, or analytics provider.

5. Data Retention

5.1. Prompts, reference images, and try-on photos

Retained by our processing provider only for the time needed to generate and deliver your result, after which they are automatically deleted from the provider's servers. We do not keep our own copy.

5.2. Generated designs and previews

Stored only on your device and remain under your control. You can delete any image at any time, and uninstalling the App removes all images stored within the App.

5.3. Usage data

Anonymized analytics data is retained for as long as necessary to analyze App performance.

5.4. Biometric data

None is collected, so none is retained. We retain biometric data for zero days, because we never receive it.

6. Security of Your Data

We use administrative, technical, and physical security measures to help protect your personal information. Images and prompts are transmitted via encrypted protocols (HTTPS/TLS). However, please be aware that no electronic transmission over the Internet is 100% secure.

7. Your Choices and Control

You can control the data the App processes at any time:

• Do not upload a photo. The text-prompt generation feature works without any image of you.
• Choose what is visible in the photo. For try-on, select or crop a photo showing only the body area you want the design previewed on.
• Delete generated images from the App or from your device's photo library at any time.
• Revoke photo library or camera permission in your device settings.
• Uninstall the App. This removes the App and all of its locally stored data, including images saved inside the App, from your device.

Because we do not store your images on our servers, there is generally no server-side copy for us to delete. If you have any question about this, or wish to make a request regarding your data, contact us at [email protected] and we will respond within 30 days.

8. User Rights (GDPR & CCPA)

8.1. GDPR (European Economic Area)

If you are in the EEA, you have the right to:

• Access: Request a copy of the personal data we hold about you.
• Rectification: Request correction of inaccurate data.
• Deletion: You can request deletion of your data by contacting us at [email protected].
• Withdraw Consent: Withdraw consent for data processing at any time, including by ceasing to use the relevant feature, as described in Section 7.

We do not process your images for the purpose of uniquely identifying a natural person, and therefore we do not process biometric data within the meaning of Article 9 of the GDPR.

8.2. CCPA / CPRA (California Residents)

• Right to Know: You may request details about the categories of personal information we collect.
• Right to Delete: You may request the deletion of your personal information.
• Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
• "Do Not Sell or Share My Personal Information": We do not sell or share your personal information, including your photos, for monetary compensation or for cross-context behavioral advertising. The App does not use device identifiers for advertising and does not share your data with advertising or measurement partners.

9. Children's Privacy

The App is not intended for children under 13 (or under 16 in jurisdictions where 16 is the minimum age of digital consent, such as parts of the EEA). We do not knowingly collect personal information from children. If we learn we have collected such information, we will delete it immediately.

Please also note that the App does not provide tattooing services; the minimum legal age for receiving an actual tattoo is set by the law of your jurisdiction and is typically 18.

10. International Data Transfers

Your information, including images, may be transferred to-and maintained on-computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ (e.g., servers in the USA or Europe). By using the App, you consent to this transfer.

11. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date.
